How to complete the Power of Attorney package.
OVERVIEW
Power of Attorney is a legal document that grants authority for an individual or third party (in this case, Namely) to act on behalf of another individual or business. Specifically, it allows us to communicate with various State Tax Agencies regarding employer tax accounts.
In general, Power of Attorney (POA) is requested proactively. It allows us to act on an employer's behalf when handling employer tax matters (i.e., tax due notices.) Some states require POA for other purposes, including the release of up-to-date withholding tax payment frequencies and unemployment insurance rates.
The Power of Attorney package is a system-generated collection of POA forms, specifically tailored to your tax obligations. Every POA requires business information from the employer (client) and the representative (Namely.) We are able to generate a POA package that populates much of your required information because our tax system stores most of the information required for POA forms. This reduces the manual entry required to complete POA packages.
Disclaimer: All Power of Attorney forms must be signed by an Officer, Owner or an Authorized person of the business with a live signature as agencies are not accepting digital signatures at this time. Power of Attorney’s will not be created if the account number is in Applied For status. A pre-filled Power of Attorney will be created once the account number is obtained and updated in Namely Payroll.

Important Notes

Power of Attorney forms should generally be signed by the owner or a corporate officer (e.g., C-level executives, President, Vice President) of your business. However, each POA form is different and should be reviewed for specific signature requirements.

In some cases, State Tax Agencies will require a notarization or witness signatures. Each form should be reviewed for specific notarization requirements.

There are generally multiple agencies responsible for employer taxes in each state, so there are usually multiple POA forms in a state POA package.
SUBMITTING POWER OF ATTORNEY FORMS
We require the completion and emailing of your Power Attorney package within seven to ten business days. We are unable to communicate with agencies regarding tax matters until we have a POA on file. Once we receive your completed package, we'll file the forms with the appropriate agencies. We'll also maintain a copy of each form for record-keeping purposes.
Email completed Power of Attorney forms with your Company ID in the Subject Line to NAMELYPOA@NAMELY.COM. If multiple POA forms are being submitted, please send one email with each state form as a separate attachment. Additionally, please ensure the forms are signed with a wet signature as electronic signatures are not accepted by states at this time.
We also encourage you to keep a separate copy of each form for record-keeping purposes.
